Terms & Conditions

These Terms & Conditions explain the rules that apply when you book or purchase a service from CookzDesignz.

By accepting a quote, booking a service, making a payment or asking CookzDesignz to start a project, you agree to these Terms & Conditions.

1. Applicability

These Terms and Conditions apply to all services, quotations, appointments and agreements between CookzDesignz and the client. By accepting a quotation, booking a service, making a payment or instructing CookzDesignz to start, the client agrees to these Terms and Conditions.

2. Services and Agreements

CookzDesignz provides creative services, including branding, brand identity, logo design, graphic design, cover art, social media designs, photo editing, motion design, promotional videos, Spotify Canvas, brandbooks and consultancy. Before work starts, CookzDesignz and the client agree on the service, price and scope of the project. Work outside the agreed service or package may be charged separately.

3. Deposit and Start of the Project

A 50% deposit is normally required before a project starts. The first 50% is the deposit and must be received in full before CookzDesignz begins work. The project is confirmed after the deposit has been received and the client has given approval. The 14-day payment term applies to other invoices unless a different payment arrangement has been agreed in writing beforehand. Final exported copy files will only be delivered after the required payment has been received in full.

4. Delivery Time and Delays Caused by the Client

The standard delivery time is approximately 14 calendar days (about 2 weeks), unless a different schedule has been agreed in advance. The delivery period starts only after the required deposit has been received, the client has approved the project and CookzDesignz has received all information and materials needed to start. If CookzDesignz is waiting during the project for feedback, approval, files, text, photographs, details or other information from the client, the delivery period is paused. Waiting days do not count towards the standard delivery time and the expected delivery date moves accordingly.

 

If the client responds later, the project resumes according to CookzDesignz's current availability and the original delivery date can no longer be guaranteed. CookzDesignz is not liable for exceeding a schedule or deadline where this is wholly or partly caused by the client providing required information, text, materials, feedback or approval late, incompletely or incorrectly. The response period and contact procedure are set out in Section 8.

5. Rush Projects

A project is considered a rush project when the requested delivery must take place within 1 to 5 calendar days. A surcharge of approximately EUR 50 to EUR 500 applies depending on the project and requested deadline. The exact surcharge is agreed in advance. Once CookzDesignz has started the rush project, the rush surcharge is non-refundable, except where the law provides otherwise.

6. Revisions and Changes

The number of included revisions depends on the selected service or package. A revision is a change within the existing design or creative direction, such as a text correction, colour change, repositioning of elements or a reasonable layout adjustment. A completely new concept, different style or major change to the original brief is not automatically a revision and may be charged as additional work. Additional costs will be communicated in advance.

7. Changing the Service During the Project

If the client changes to a clearly different or larger service during the project, CookzDesignz may treat this as a new service or an additional project. Work already completed for the original service will not be converted into a new service free of charge. Any additional costs will be discussed in advance.

8. Communication and Response Period

Email and WhatsApp may be used as official communication channels. When CookzDesignz requires feedback, approval, information or files, the client is expected to respond within 2 business days. If no response is received within 2 business days, the project schedule is paused. CookzDesignz will then make a second attempt to contact the client. If the client still does not respond, CookzDesignz may pause or close the project. If a closed or long-paused project must later be rescheduled, a new schedule will be determined according to current availability. Where additional planning or work is required, CookzDesignz may propose a restart fee or new pricing arrangement before continuing.

9. Client Materials

The client is responsible for providing text, names, prices, dates, contact details, photographs, videos, logos, fonts and other materials correctly and on time. The client confirms that they have permission to use the supplied materials. CookzDesignz is not responsible for copyright or licensing problems arising from materials supplied by the client.

10. Cancellation and the Statutory Cooling-off Period

Consumers who book a service online or at a distance may have a statutory 14-day cooling-off period, starting on the date the agreement is concluded. The client does not have to wait 14 days before CookzDesignz starts. If the client expressly requests or agrees that CookzDesignz may start within this period, CookzDesignz may begin immediately after approval and receipt of the required deposit. If the consumer cancels during the cooling-off period after work has started, the consumer may be required to pay for the part of the service performed up to the time of cancellation. If the service is fully completed during the cooling-off period, the statutory right of withdrawal may expire where the legal requirements have been met. Statutory consumer rights always remain applicable.

11. Cancellation After Work Has Started

Outside any applicable statutory cooling-off period, the 50% deposit is non-refundable once CookzDesignz has started work. If the value of the work already completed exceeds the amount paid, CookzDesignz may invoice the additional completed work. If CookzDesignz itself cannot complete a project, the completed portion and any amount to be refunded for work not performed will be assessed on a case-by-case basis.

12. Final Payment and Delivery

The remaining payment must be made before final exported copy files are delivered, unless a different payment arrangement has been agreed in writing in advance. Before full payment, previews, concepts or watermarked files may be shared. Final exported copy files are delivered in the formats agreed for the selected service.

13. Editable and Source Files

Editable files and working files, such as Photoshop, Illustrator, After Effects or other project files, are not automatically included. If the client requires these files, this must be agreed separately and an additional fee may apply.

14. Copyright and Use

Copyright in the original creative work remains with CookzDesignz to the extent permitted by law. After full payment, the client receives the agreed right to use the final approved design for the purpose agreed in advance. The client may not sell the design as their own design work or allow another person to resell CookzDesignz's original work. Fonts, stock images, mockups and other third-party assets may be subject to separate licence terms.

15. Portfolio and Promotion

CookzDesignz may display completed work on its website, social media, portfolio, presentations and promotional materials unless it has been agreed in writing beforehand that the project is confidential or may only be published after a specified date.

16. Review and Approval by the Client

Before final approval, the client checks spelling, names, telephone numbers, email addresses, websites, prices, dates, dimensions and other important information. Corrections requested after final approval may be charged as additional work. This is particularly important when a design will be printed or produced.

17. Printing and Production

Where an external printer or producer is used, the client is responsible for providing or checking the correct technical specifications unless CookzDesignz has expressly accepted this as part of the project. Colours may vary between screens, printers and production methods. CookzDesignz therefore cannot guarantee exact colour reproduction on every device or through every production method.

18. Consultancy and Appointments

A consultancy appointment is confirmed only after the agreed deposit or payment has been received. The client may be no more than 15 minutes late. If the client changes the appointment before CookzDesignz has left for the location, a new appointment may be scheduled without additional travel or no-show costs. If CookzDesignz is already travelling and the appointment cannot proceed because of the client, an additional EUR 20 to EUR 50 may be charged depending on the location and travel undertaken. The original deposit is not automatically refunded.

19. No Guarantee of Marketing Results

CookzDesignz provides creative and design services. Professional design may contribute to a brand's presentation, but CookzDesignz does not guarantee specific sales, revenue, customers, followers, reach, views, engagement or other marketing results unless a separate performance agreement has expressly been made.

20. Liability

CookzDesignz performs projects to the best of its ability and with professional care. CookzDesignz is not responsible for loss or damage caused by incorrect information from the client, incorrect use of the design, problems involving third-party suppliers or results beyond CookzDesignz's control. To the extent permitted by law, liability is limited to the amount paid for the relevant project. Statutory rights that cannot be excluded remain applicable.

21. Respect and Termination

CookzDesignz may terminate a collaboration in the event of threatening, insulting, discriminatory or repeatedly disrespectful behaviour. If the project has already started, work already performed and costs already incurred will be taken into account in the financial settlement.

22. Force Majeure

In circumstances outside CookzDesignz's reasonable control that temporarily prevent the project from being performed, the project may be paused. CookzDesignz will inform the client as soon as possible and discuss when and how the project can continue.

23. Complaints

Complaints regarding a delivery must be reported as soon as possible and preferably within 30 days after delivery. CookzDesignz must first be given a reasonable opportunity to correct a valid problem. Additional requests outside the agreed project may be charged as additional work.

24. Governing Law

Agreements with CookzDesignz are governed by Dutch law. In the event of a dispute, CookzDesignz and the client will first try to reach a solution together. Mandatory statutory consumer rights remain applicable.

25. Amendments to These Terms

CookzDesignz may amend these Terms and Conditions. For an existing project, the version that applied when the project was booked will generally remain applicable unless CookzDesignz and the client agree otherwise in writing. These are practical business terms. For complete legal certainty, particularly when providing services to consumers in the Netherlands or other EU countries, review by a legal professional is recommended.
